These Terms of Use (“Terms”) are an agreement between you and [COMPANY NAME] (“we”, “us”) about your use of the CineSwap mobile app and the website at cineswapai.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms. Please also read our Privacy Policy, which explains how we handle your information.
1. Who can use CineSwap
You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian.
2. Your account
Keep your sign-in details private and the information in your account accurate. You are responsible for everything that happens in your account. Each account is for one person and may not be shared or sold.
3. Tokens
- Creating content costs tokens. The cost is shown on the Generate button before you start.
- If a creation fails or is blocked by our safety checks, its tokens are refunded to your account automatically.
- Tokens have no cash value and cannot be transferred, exchanged or sold.
- Token packs are purchased through the App Store or Google Play, and refunds follow their policies. We may change token prices for future purchases.
4. CineSwap Pro
CineSwap Pro is a subscription purchased through the App Store or Google Play. It currently includes 3,000 tokens every month, exports without a watermark, a priority rendering queue, and 1080p and 10-second videos. We may change these benefits, and we will tell you in advance if a change affects your current subscription.
Subscriptions renew automatically until you cancel them. You can cancel at any time in your App Store or Google Play subscription settings; Pro then stays active until the end of the period you paid for. Refunds are handled by Apple or Google under their policies.
5. Your content and other people’s faces
You keep the rights to the photos, videos and prompts you upload. You give us a limited licence to store and process them only to provide the Service to you.
You may only upload photos and videos that you have the right to use. If a photo shows anyone other than you, you must have that person’s permission to use their face in the Service.
6. What you must not do
You must not use the Service to:
- use anyone’s face without their permission, or impersonate, mislead, harass or defame anyone;
- create sexual or intimate content involving real people, or any content involving minors;
- create hateful, violent, illegal or harmful content, or content that infringes someone else’s rights;
- present AI-generated content as real in a way that could deceive people, for example in political, financial or news contexts;
- copy, reverse engineer or overload the Service, get around its limits or safety checks, or remove watermarks.
7. Your creations
Creations are generated by AI and may be inaccurate or unexpected. They are labelled as AI-generated content.
You may use your creations for personal, non-commercial purposes in line with these Terms. Creations made on the free plan include a CineSwap watermark, which you must not remove. Creations are deleted automatically after 30 days, so save the ones you want to keep.
8. Our rights
The Service, including its templates, design, software and trademarks, belongs to us or our licensors. These Terms do not give you any rights to them other than the right to use the Service as described here.
9. Moderation and enforcement
We may block content, remove creations, and suspend or close accounts that break these Terms. Where the law requires it, we report illegal content to the authorities. If you think we made a mistake, contact us at [email protected].
10. Changes to the Service and these Terms
We are always improving the Service, so features may change, and the Service may sometimes be unavailable. We may also update these Terms. If a change is significant, we will tell you in the app before it takes effect. If you keep using the Service after that, you accept the updated Terms.

The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will always be available, error-free or suitable for a particular purpose.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for any loss of data, profits or goodwill. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer.
13. Ending your use
You can stop using the Service and delete your account at any time in the app, or on our account deletion page. We may end or suspend your access if you break these Terms.
14. Governing law
These Terms are governed by the laws of [JURISDICTION]. This does not take away any mandatory consumer protection you have under the laws of the country where you live.
15. App Store terms
If you use the iOS app, these Terms are between you and us, not Apple. Apple has no responsibility for the Service or its content, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
